Please read these Terms and Conditions carefully before using the Selfie Spark mobile application. By accessing or using our service, you agree to be bound by these terms.
By downloading, installing, or using the Selfie Spark mobile application ("App," "Service," or "we"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.
These Terms constitute a legally binding agreement between you and Zine Inc, located at Bul "Vl Varnenchik" 81, office 11, Varna, Bulgaria.
If you are using the Selfie Spark mobile application on an iOS device, the following terms also apply to you:
You and Zine Inc acknowledge that these Terms are concluded between you and Zine Inc only, and not with Apple Inc. ("Apple"). Zine Inc, not Apple, is solely responsible for the Selfie Spark App and the content thereof.
The license granted to you for the Selfie Spark App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple App Store Terms of Service, except that such App may be accessed and used by other accounts associated with you via Family Sharing.
Zine Inc is solely responsible for providing any maintenance and support services with respect to the Selfie Spark App, as specified in these Terms or as required under applicable law. You and Zine Inc acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Zine Inc is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in Section 9 ("Disclaimers and Warranties") of these Terms.
In the event of any failure of the Selfie Spark App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Zine Inc's sole responsibility.
You and Zine Inc acknowledge that Zine Inc, not Apple, is responsible for addressing any claims by you or any third party relating to the Selfie Spark App or your possession and/or use of the App, including, but not limited to:
You and Zine Inc acknowledge that, in the event of any third-party claim that the Selfie Spark App or your possession and use of the App infringes that third party’s intellectual property rights, Zine Inc, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that:
Any of your questions, complaints, or claims with respect to the Selfie Spark App should be directed to Zine Inc, as specified in Section 17 ("Contact Information") of these Terms.
You must comply with any applicable third-party terms of agreement when using the Selfie Spark App (e.g., you must not be in violation of your wireless data service agreement when using the App).
You and Zine Inc acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
Selfie Spark is a mobile application available on iOS and Android that uses artificial intelligence to apply creative effects and filters to photographs. Our Service allows you to upload photos and receive AI-generated filtered versions of your images.
You must be at least 13 years of age to use this Service. By using Selfie Spark, you represent and warrant that you meet this age requirement. If you are under 18 years of age, you must have permission from a parent or legal guardian to use this Service.
By installing Selfie Spark, an account is automatically created, linked to your device. All devices signed into the same Apple Account or Google Account will share the same subscription and generation credits.
Selfie Spark offers two subscription tiers, both billed monthly:
All subscriptions are processed through the Apple App Store or Google Play Store. By subscribing, you authorize Apple or Google to charge your payment method on a recurring monthly basis until you cancel your subscription. Prices are set in your local currency and may be subject to applicable taxes.
You may cancel your subscription at any time through your device's subscription settings:
Upon cancellation, you will retain access to your subscription features and credits until the end of your current billing period. After that, you will lose access to paid features and any remaining credits.
Refunds are governed by Apple's and Google's respective refund policies. We do not process refunds directly. To request a refund, please contact Apple or Google support according to their standard procedures.
Subscriptions are non-transferable between unrelated accounts and cannot be transferred between iOS and Android platforms. Family sharing is supported as per Apple and Google's family sharing policies.
You retain full ownership of all photographs you upload to Selfie Spark ("Your Content") and all images generated by our Service from Your Content ("Generated Images"). We do not claim any ownership rights to Your Content or Generated Images.
By uploading photos to our Service, you grant Zine Inc a limited, non-exclusive, royalty-free license to process, store, and manipulate Your Content solely for the purpose of providing the Service to you. This license terminates when your images are deleted from our servers after processing is complete.
You are free to use Generated Images for both personal and commercial purposes. You are solely responsible for ensuring that your use of Generated Images complies with applicable laws and does not infringe on third-party rights.

We reserve the right to investigate violations of these Terms. Violations may result in account suspension or termination, removal of content, and/or reporting to law enforcement authorities as appropriate. We may terminate your access to the Service immediately and without notice if we determine, in our sole discretion, that you have violated these Terms.
We strive to maintain the availability and reliability of Selfie Spark. However, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of features, filters, or functionality. We may introduce new features or remove existing features without prior notice. We are not liable to you or any third party for any modifications, suspensions, or discontinuance of the Service.
The Selfie Spark application, including its design, features, functionality, software code, and all related intellectual property, is owned by Zine Inc and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms.
Selfie Spark uses artificial intelligence to generate and process images. AI technology is not perfect and may produce unexpected, inaccurate, or unsatisfactory results. We do not guarantee the quality, accuracy, or suitability of Generated Images for any particular purpose. You acknowledge that AI-generated content may contain errors, artifacts, or imperfections.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZINE INC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
You agree to indemnify, defend, and hold harmless Zine Inc, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
You may terminate your account at any time by canceling your subscription and deleting the App from your device.
These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Varna, Bulgaria.
You agree to submit to the personal jurisdiction of the courts located in Varna, Bulgaria for the purpose of litigating all such claims or disputes.
We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify you by updating the "Effective Date" at the bottom of these Terms and, where appropriate, provide additional notice through the App or via email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Zine Inc regarding the use of the Service and supersede any prior agreements between you and Zine Inc relating to the Service.
